Lab Results Interpretation Disclaimer & Privacy Notice

This service allows you to upload laboratory results (“Lab Results”) to the Felix Health Inc. (“Felix”) platform (the “Platform”) to receive an automated, AI-generated interpretation (the “Interpretation”). By uploading your Lab Results, you acknowledge that you have read and agree to the terms of this disclaimer and privacy notice.

This service does not include the provision of Healthcare Services as defined in the Felix Health Terms of Use. For information on how Felix handles your personal information generally, please refer to the Felix Health Privacy Policy.

Nature of the Service

Informational purposes only. Interpretations generated through this service are for general informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment, and should not be relied upon as such.

No healthcare professional review. Interpretations are generated by an automated AI system and are not reviewed, approved, or verified by a physician, nurse practitioner, or any other regulated health professional. No physician-patient or provider-patient relationship is created through your use of this service.

No medical record integration. If you have an existing medical record with Felix, Lab Results uploaded through this service will not be added to that record and will not be visible to or reviewed by any Felix healthcare provider. This means that any Felix physician or nurse practitioner providing you with care through the Platform will not have access to these results unless you share them directly. Felix recommends that you share any clinically relevant results with your healthcare provider to ensure continuity of care.

Critical or abnormal values. This service does not include automated monitoring for critically abnormal laboratory values, and no alert system is in place to flag results that may require urgent clinical attention. You should not rely on this service to identify whether your results require immediate follow-up. If you have any concern about your results, contact a qualified healthcare provider promptly. If you are experiencing symptoms or believe your results indicate a medical emergency, call 911 or go to your nearest emergency department immediately.

Consult a healthcare professional. Do not use this service to make decisions about your health, medications, or treatment. Always consult a qualified healthcare provider such as a physician, nurse practitioner, or pharmacist regarding your Lab Results and any health concerns.

Emergency situations. This service is not intended for use in a medical emergency. If you are experiencing a medical emergency, call 911 or go to your nearest emergency department immediately.

Regional availability. This service is available to individuals located in the provinces served by the Platform, which currently include Ontario, British Columbia, Alberta, Saskatchewan, Manitoba, Nova Scotia, Prince Edward Island, and Newfoundland and Labrador. The service is not available in Quebec, New Brunswick, or the territories. The Interpretation available to you may depend on your province of residence and applicable law in that jurisdiction.

Limitations of AI-generated interpretations. AI systems may generate responses that appear plausible but are factually incorrect or incomplete, a phenomenon known as hallucination. Interpretations generated through this service have not been reviewed by a human and may contain errors. Additionally, the AI system has a training knowledge cutoff date and may not reflect the most recent clinical guidelines, reference ranges, or medical research. This service is intended only for standard clinical laboratory results. It may not be appropriate for complex, specialized, or non-standard results including but not limited to genetic panels, pathology reports, or rare biomarker assays. Felix makes no representation that the service is suitable for interpreting results of this nature, and you are encouraged to consult a qualified healthcare provider directly for any results of a complex or specialized nature.

Minimum age. This service is intended for use by individuals who are 18 years of age or older and who have legal capacity to consent on their own behalf. If you are consenting on behalf of a minor or an individual who lacks legal capacity, you represent that you are authorized under applicable law to do so and that you are acting in that individual’s best interests. Felix reserves the right to request evidence of authority to act as a substitute decision-maker.

Privacy and Data Collection

Subprocessor. This service is powered by an automated AI system provided by Phelix AI Inc. (“Phelix AI”), which acts as a data processor on behalf of Felix. All processing of your Lab Results occurs exclusively within Canadian data centre regions; your personal health information does not leave Canada. Phelix AI is contractually prohibited from using your identifiable Lab Results or Interpretations for its own purposes and is subject to security and confidentiality obligations equivalent to those imposed on Felix. Felix remains responsible for ensuring that Phelix AI handles your information in compliance with applicable law.

Collection and use. Your Lab Results constitute personal health information. By uploading your Lab Results, you consent to Felix collecting, using, and storing that information solely for the purpose of generating an Interpretation for your personal, non-commercial use, in alignment with the Felix Health Privacy Policy.

Types of information collected. In connection with this service, Felix may collect the following categories of personal health information included in or associated with your Lab Results:

  • Identifying information: name, date of birth, health card number
  • Clinical information: biomarker values, reference ranges, ordering provider details, collection date
  • Any other information you choose to include in an uploaded file

Training. Your Lab Results and any associated Interpretations will not be used to train, fine-tune, or otherwise update any AI model without your separate and explicit written consent.

Access. Lab Results and Interpretations may be accessed by Felix’s technical and support teams solely for the purpose of operating and improving this service, and only as permitted by applicable law.

Data storage and retention. Your Lab Results and any associated Interpretations are stored on secure, encrypted servers located in Canada. Felix does not retain your Lab Results file following the processing of the document the Interpretation, but will retain the information within your Lab Results for the purposes of providing the services. Felix retains this information for a period of 3 years from the date of upload, after which it is securely deleted or de-identified in accordance with applicable law. If you request deletion of your information prior to the end of this period, Felix will respond to your request within the legally required time period, subject to any legal obligation requiring retention. Upon termination of your Felix account, your Interpretations will be securely deleted within 30 days, subject to any applicable legal retention requirement.

Your privacy rights. You have the right to access, correct, and request the deletion of your personal health information held by Felix in connection with this service. To exercise any of these rights, please contact Felix’s Privacy Officer at [email protected]. Felix will respond to requests within the timeframes required by applicable law. You also have the right to withdraw your consent to the collection, use, and storage of your Lab Results or Interpretations at any time by contacting [email protected]. Withdrawal of consent will result in the deletion of your Lab Results and any associated Interpretations and will disable your access to this service. Withdrawal of consent will not affect your access to other Felix services. If you believe your privacy rights have not been respected, you have the right to lodge a complaint with the applicable privacy regulator, including the Office of the Privacy Commissioner of Canada (www.priv.gc.ca) or the relevant provincial privacy commissioner in your jurisdiction.

Applicable privacy law. Felix handles personal health information in compliance with applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA), or applicable substantially similar provincial legislation. Applicable provincial legislation includes:

  • Ontario: Personal Health Information Protection Act (PHIPA)
  • British Columbia: Personal Information Protection Act (PIPA)
  • Alberta: Health Information Act (HIA)
  • Saskatchewan: Health Information Protection Act (HIPA)
  • Manitoba: Personal Health Information Act (PHIA)
  • Nova Scotia: Personal Health Information Act (PHIA)
  • Prince Edward Island: Health Information Act (HIA)
  • Newfoundland and Labrador: Personal Health Information Act (PHIA)

Security

Safeguards. Felix implements reasonable administrative, technical, and physical safeguards to protect your personal health information from unauthorized access, disclosure, alteration, or destruction. However, no method of electronic transmission or storage is completely secure, and Felix cannot guarantee absolute security.

Encryption. Where possible, information transmitted through this service is encrypted. You acknowledge that, despite these measures, there are inherent risks associated with transmitting information electronically.

Accuracy and Liability

Accuracy. While Felix takes reasonable steps to ensure the quality of Interpretations, we cannot guarantee that any Interpretation will be complete, accurate, current, or appropriate for your individual circumstances. Interpretations are generated by an AI system and may contain errors or omissions. Further, Interpretations do not go through human review and may therefore yield inaccurate or incomplete information.

Limitation of liability. Felix expressly disclaims any liability for any direct, or indirect, incidental and/or consequential damages arising from your use of or reliance on this service or any Interpretation generated through it. Users bear sole responsibility for their reliance on any information provided through this service. Notwithstanding any other provision of this notice, nothing herein limits or excludes Felix’s liability for gross negligence, fraud, or wilful misconduct, or any other liability that cannot be excluded or limited under applicable law.

Miscellaneous

Governing law. This disclaimer and your use of this service are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without reference to conflict of laws provisions.

Appropriate use. You agree to use the Interpretation services only in compliance with all applicable local, provincial, national, and international laws, regulations, and legal obligations, including the Felix Health Terms of Use and Privacy Policy. It is prohibited to use the Interpretation services to engage in, promote, facilitate, or assist any unlawful, fraudulent, harmful, or deceptive activity. You represent that any information you share with the Interpretation services does not violate any intellectual property right, privacy right, or any other rights of any third party.

Material changes. Where Felix makes changes to this notice that materially affect how your personal health information is collected, used, or disclosed, Felix will provide you with direct notice prior to those changes taking effect and will seek fresh consent where required by applicable law. Your continued use of the service following notice of non-material changes constitutes your acceptance of those changes. You may always withdraw your consent and discontinue use of the service if you do not agree to any updated terms.

Disputes. The parties agree to first attempt to resolve any dispute arising out of or relating to this notice or your use of this service informally by contacting Felix at [email protected]. If a dispute cannot be resolved informally within 30 days, it may be referred to the courts of competent jurisdiction in the Province of Ontario, which shall have exclusive jurisdiction over such disputes, subject to applicable law.
