External Service Testing Program Terms and Conditions
Introduction
Felix Health Inc. (“Felix”) is committed to continuously improving its platform (the “Platform”) and the professional services provided on or through Felix by Nurse Practitioners and Physicians (the “Services”). To support this initiative, under the External Service Testing Program (the “Program”), Felix will provide a discount code (“Code”) to a friend or family member of a Felix employee which will cover the professional service fee associated with the Services, if applicable (the “Visit Fee”).
The Code will provide free access to Felix professional services delivered through the Platform by nurse practitioners and physicians in exchange for feedback on their experiences with the Platform, its services, and other services within the Canadian healthcare system.
This policy outlines the terms and conditions of the Program, privacy rights and obligations, and procedures to register for the Program
All terms and conditions of this policy may be subject to change at any time and are subject to the Terms of Use, Privacy Policy, and any other ancillary policies of the Platform.
Eligibility
Only individuals who have successfully registered and met the minimum requirements for participation are eligible for access to the Program (“Participants”). Specifically, Participants must be Canadian residents located in a province serviced by Felix, and be at least 18 years of age or the age of majority in their province.
The Services
The Program only applies to the professional services delivered by registered nurse practitioners and physicians on the Platform. Your right to use the Platform and its Services is limited to those rights expressly set out in these terms. You agree that you will not make any commercial exploitation of the Platform or create any competing product or service.
By accessing the Program and using the Platform, all assessments will be handled with the same standard of care and confidentiality as defined in the Felix Terms of Use and Privacy Policy. Visits therefore will include, as applicable:
- completion of an intake questionnaire on the Platform;
- review of medical file/medical history by assigned healthcare practitioner;
- discussion of medical history with a healthcare practitioner;
- if applicable, the issuance of a requisition for medical testing and subsequent interpretation of results;
- if applicable, the prescribing of a treatment plan and ongoing management; and/or
- ongoing discussion with assigned healthcare practitioner(s).
Discount Codes
The Code provided through the Program is solely for use by the intended recipient.
Each code provides the Participant with ten free Visit Fees per each three month period in the Felix care category of their choosing. Each code automatically expires after the three month period. The Code is non-transferable and cannot be combined with any other promotions or offers. Participants may only possess one code under the Program at a time.
The Code is limited to Visit Fees, and does not provide a discount on health products, including but not limited to prescription drugs, non-prescription drugs, natural health products, and medical devices, offered through the Platform. The code does not cover insured or uninsured medical testing services, such as medical laboratory testing that may or may not be covered by the provincial or territorial schedule of benefits.
Codes are individually assigned and are only intended to be used by the Participant, as described under “Eligibility”. It is prohibited to share Codes with other individuals, such as through public forums, as a part of a public social media post, or in any private or public channels. The exchange of funds or other forms of remuneration, including personal benefit, for the Code is also prohibited.
Testing
The Participant agrees to test the Platform and its services in accordance with our reasonable instructions. In testing and evaluating the Platform and its services, the Participant agrees to provide optional feedback on the experience, the user interface, and any other relevant information to the Felix Product team via the methods outlined in the “Providing Feedback” section.
Privacy and Consent
The aim of the Program is to collect feedback willingly provided by participants that does not involve the disclosure of personal information, unless at the sole discretion of the Participant.
Agents of the company (e.g. any Felix employees, independent contractors, or healthcare practitioners conducting work for or on behalf of the company) not involved in the participant’s medical assessment or treatment will not be able to access patient accounts or profiles without express consent from the participant, and all access will be logged in Felix Audit and System logs. In accordance with its privacy policies and practices, Felix will ensure the privacy of Participants is being maintained.
Revocation of consent of participation in the program can be directed to the Felix Compliance team at compliance@felixforyou.ca. Any revocation of consent will automatically result in the cancellation of the Code. Revocation of consent does not remove record of participation or the Participant’s medical record from the Platform.
Despite these safeguards, there is still a minor risk that by participating in the Program, personal health information, including that which may be sensitive in nature, may become available to individuals not otherwise authorized to access it. Should this occur, the impacted user will be promptly notified, and an investigation will be conducted by the Felix Compliance team in compliance with applicable laws and regulations.
Method of Delivery
Code request, creation and assignment will be managed by the Felix Compliance team.
This Code will be provided to the eligible user upon request via the External Service Testing Program Request Form. By submitting the form, you consent to participate in the Program, but may revoke this consent by contacting compliance@felixforyou.ca at any time. All information submitted through this form will be kept confidential.
Each participant will be assigned a unique Code that is traceable to the individual. These codes will then be generated by the Felix Compliance team, tracked in program documentation, and privately shared to the user via the preferred method of communication as expressed in the Request Form (e.g. email, etc).
Minimum turnaround time for Code creation is three to five business days.
Providing Feedback
The privacy of Felix users, including the Participants, is always Felix’s priority. Participants are not required to disclose any information related to receiving care through the Platform. Though highly encouraged and the original intent of the Program, all feedback on the experiences of participants using the Platform and accessing the Services through the Program is entirely optional.
Should a participant wish to provide feedback, it can be submitted and shared via email to compliance@felixforyou.ca, or alternatively directed to the participant’s friend or family member working for Felix who will then provide the feedback in authorized company channels. All feedback will be shared without identifiers (i.e. will be shared anonymously), unless explicitly consented to by the Participant.
In certain circumstances, follow up questions may be asked to clarify experience, and the Felix team may request an interview. The Participant consents to receive communications related to these questions or requests, but reserves the right to not engage should they wish to
Confidentiality
The Participant will use all reasonable efforts (which shall consist of at least the same level of diligence as they may use to protect your own proprietary information and trade secrets) to protect the confidentiality of the Platform and Services, including all product features, and our other confidential information that may come to your attention or knowledge as a result of using the Platform and the Services. You shall not copy, publish, disclose, attempt to recreate the source code version of the Platform or make any use other than as contemplated herein of the Platform or any such confidential information. You also agree not to communicate or otherwise disclose to us during the term any confidential or proprietary information of any other third party.
Warranties
The Platform and Services are provided "as is". Felix makes no representation, warranty or guarantee with respect to the Platform and assumes no liability for its use or performance. We reserve the right to alter aspects of the Platform, including but not limited to the user interface, screen displays, fonts and functionality. We specifically disclaim any and all liability for damages of any kind caused by the use, unavailability, or otherwise related to the Platform in any way.
Audit
All codes issued to participants under this policy are subject to audit for the purposes of Felix policy and payroll compliance. In the course of an audit, the Felix Compliance and Payroll teams may gain access to limited information associated with the codes and the users, including date of use of Codes, services accessed using the Program, and appropriate use. This information will be kept strictly confidential and will not be disclosed outside of these teams. Audit terms and requirements will apply even after a participant has withdrawn from the program, consent to audit is therefore irrevocable.
Enforcement
Misuse of this program will result in permanent suspension from the program and barring from future programs of similar nature.
